Additional Limitations. The policy owner, and not LSNW , is fully responsible for the timely payment of any and all premiums due for the policy that is the subject of the viatical or life settlement transaction, on the applicable due dates, up until change of ownership of the policy occurs. The policy owner, not LSNW, assumes sole responsibility if the policy lapses for such lack of timely payment of any and all premiums. In addition, LSNW is not a life expectancy provider or firm that produces life expectancy reports; does not determine life expectancies; is not a medical or mortality expert; does not provide mortality or medical reviews; does not evaluate the health of the insured; is not responsible for the conclusions of life expectancy providers and/or firms that produce life expectancy reports; and does not have the expertise to dispute the conclusions of life expectancy providers and/or firms that produce life expectancy reports. The insured may live longer or shorter than any life expectancy projection or estimate.

Personal Information Collection: LSNW collects personal information in connection with the following activities: Life, viatical, and structured settlements, loans, life insurance coverage, marketing/advertising and financial products and services. Such data may be collected electronically and/or in writing from you, insurance carriers, and healthcare providers. We classify information in three categories; basic personal information, financial information and protected health information. Information from your insurance carriers may only be requested with your executed “Insurance Authorization. Protected health information may only be obtained from healthcare providers with your completed “HIPAA Disclosure Authorization” pursuant to the Health Insurance Portability and Accountability Act of 1996 (the “HIPAA Privacy Regulations).

Personal Identifiable Information is any information that can be used to identify and locate a particular person or entity. This includes basic personal, financial and protected health information. Basic Personal Information includes, but is not limited to: personal name, company name, mailing address, telephone number, mobile number, fax number, email address, date of birth, sex, marital status, personal preferences and interests. Financial information includes, but is not limited to social security number, federal employer identification number, insurance information, income, and legal matters. Protected health information includes, but is not limited to: medications, physical or mental condition(s), including psychiatric conditions, information relating to HIV or AIDS tests, and drug or alcohol abuse.

Non-personally Identifiable includes the type of browser you are using (e.g. Firefox, Internet Explorer, Chrome, Safari, etc.), the type of operating system you are using, (e.g. Windows 8 or Mac OS, etc.) and the domain name of your internet service provider (e.g. Comcast, Windstream, Yahoo, Gmail, etc.). We use the Non-Personally Identifiable information that we collect to improve the design and content of the Website and to enable us to personalize your LSNW related internet experience. We also may use this information in the aggregate to analyze Website usage.
Discretion to Use Information: LSNW may use personal information for any legally permissible purpose in company’s sole discretion including, but not limited to providing promotional offers to individuals by means of email advertising, telephone marketing, direct mail marketing, online banner advertising, and package stuffers, among other possible uses (see below for details). LSNW may change or broaden its use at any time.

  1. Email – LSNW uses Personal Information to provide promotional offers by email to individuals. LSNW may maintain separate email lists for different purposes. If email recipients wish to end their email subscription from a particular list, they need to follow the instructions at the end of each email message to unsubscribe from the particular list. To unsubscribe from all LSNW email lists, you must send an email to unsubscribe@lifesettlementsnw.com.
  2. Content of Email Messages – In certain commercial email messages sent by LSNW, an advertiser’s name will appear in the From: line but hitting the Reply button will cause a reply email to be sent to LSNW. The Subject: line of LSNW email messages will usually contain a line provided by the advertiser to LSNW.
  3. Solicited Mail – LSNW only sends email to individuals who have agreed on the Website to receive email from LSNW or to individuals who have agreed on Third Party websites to receive email from Third Parties such as LSNW.
  4. Targeted Advertising – LSNW uses Personal Information to target advertising to an individual. When an individual is using the internet, LSNW uses Technology Information (see below) to associate an individual with a person’s individual information, and LSNW attempts to show advertising for products and services in which the person has expressed an interest in the Surveys, indicated an interest by means of Technology Information, and otherwise. LSNW may, at its discretion, target advertising by using email, direct mail, telephones, cell phones, and other means of communication to provide promotional offers.
  5. Direct Mail and Telemarketing – LSNW uses Personal Information to advertise directly or indirectly, to individuals using direct mail marketing or telemarketing using telephones and cell phones.
  6. Mobile Phone SMS Messages – In certain cases, when requested by an individual, a Third Party may use Personal Information to provide customized content and advertising via SMS messaging to an individuals’ cell phone. LSNW is not responsible for the privacy practices or the content of such Third Parties.
  7. Use of Technology Information – LSNW uses Technology Information (1) to match a person’s Survey Information and Third Party List information to other categories of Personal Information to make and improve profiles of individuals, (2) to track a person’s online browsing habits on the internet, (3) to determine which areas of LSNW web sites are most frequently visited. This information helps LSNW to better understand the online habits of individuals so that LSNW can target advertising and promotions to them.
  8. Profiles of Individuals – LSNW uses Personal Information to build a profile of an individual. A profile can be created by combining Survey Information and Third Party List information with other sources of Personal Information such as information obtained from public databases.

Sale or Transfer to Third Parties: LSNW may sell or transfer Personal Information to Third Parties for any legally permissible purpose in LSNW sole discretion, with the exception of Protected Health Information. If you believe that any information we are holding on you is incorrect or incomplete, please write to LSNW as soon as possible at info@lifesettlementsnw.com. We will promptly correct any information found to be incorrect.

Security: LSNW is committed to ensuring that your information is secure. In order to prevent unauthorized access, loss, misuse, or alteration, all information is stored in a technically and physically secure environment.
